How to file amendment on debt not included in BK

How to file amendment on debt not included in BK

Letter to “Ask Leon”

I have been discharged from Ch.7 since November 2005. I recently got a letter from collection agency in regards to an old debt ($800). I was not aware of this debt and at the time of me filing bankruptcy it was not showing on my credit report. I just wanted to know since it was an old debt that occurred before my bankruptcy do I have any options on getting the debt included in my discharge?

Leon Says…

I suggest that you immediately inform them of the bankruptcy. The general rule provides that debts not listed are discharged anyway, provided that the debt is the type of debt that would have been were no assets to be distributed to the creditors by your bankruptcy trustee.
