Getting Out of a Ch 13 Bankruptcy

Letter to “Ask Leon”

We filed a Chapter 13 1 ½ years ago. It has been difficult to keep up the mortgage payment since the bankruptcy. We are behind on the mortgage and cannot roll it into the bankruptcy. Is it possible to get out of the Chapter 13 bankruptcy, and re-finance the mortgage to re-pay the debt and start over with a new mortgage?

I would not want to suggest that without reviewing your case thoroughly. There might be danger in giving up the court protection, and sometimes the loan doesn’t fund. Here’s a better idea. You might be able to refinance now, while you are in the 13 and pay off your Plan! I have done this for many of my clients. Discuss this with your attorney.
