Chapter 7 or 13?
Letter to “Ask Leon”
I live in Tennessee. I am a single mom with 3 dependents for tax purposes and I know I need to file bankruptcy. I just don’t know which one is more appropriate for me. I own my home, have a Home Equity Line of Credit that is maxed out, and support. Why would I NOT want to file chapter 7? Does 13 have an advantage or is it seen as more noble in the eyes of creditors? I can’t decide.

Among other things, the lawyer will need to know your total income from all sources during the past 6 months, what your current necessary living expenses are, the current market value of your home, and all amounts that you owe on it.
