Letter to “Ask Leon”

My husband had a chapter 7 bankruptcies that he filed in 1998 and was discharged in 1999. We are in need of filing again due to a disabled mother that is to move in with us. How much time has to pass between bankruptcies?

A new law took effect on October 17, 2005. Under the new law, the time has been increased from 6 years to 8 years for filing a Chapter 7. (The time frames are different for Chapter 13.) The time runs from the date the old case was filed, not from the date it was discharged. Assuming that his old case was filed prior to October 10, 1998, he can file now. If not, he doesn’t have very long to wait!
