We filed a ch 13 Bk 1/2 years ago. It has been difficult to keep up the mortgage payment since the bk. we are behind on the mortgage and cannot roll it into the Bk. Is it possible to get out of the ch 13 Bk, and re-finance the mortgage to re-pay the debt and start over with a new mortgage?

I would not want to suggest that without reviewing your case thoroughly. There might be danger in giving up the court protection, and sometimes the loan doesn’t fund. Here’s a better idea. You might be able to refi now, while you are in the 13 and pay off your Plan! I have done this for many of my clients. Discuss this with your attorney.
