CAN I DO A BANKRUPTCY WITH A JUDGEMENT ALREADY AGAINST ME ON THE CAR

CAN I DO A BANKRUPTCY WITH A JUDGEMENT ALREADY AGAINST ME ON THE CAR

Letter to “Ask Leon”

Behind on car note 9 months was planning on playing catch up around tax season. Was summons to court in November 2006 .I didn’t show because I couldn’t get off work? Would like to file ch 13. Haven’t been able to register the car due to money issues will I be able to register the car and file my chapter 13?

Leon Says…

A Chapter 13 case is always subject to the requirement that the plan is proposed in “good faith.” If someone has been hiding a vehicle for 9 months and failed to properly register the vehicle, the court might view that as bad faith. On the other hand, what is there to lose? You really need guidance from a good local bankruptcy attorney. Assuming that you are otherwise eligible and qualified to file a case, it sounds worth a try; if you really want t keep the car.
