Letter to “Ask Leon”
My bankruptcy was discharged 06/2004. Since then I have had no reporting from a Capital One credit card. However, the past 2 months they have reported Charge-Offs on the old account which has dropped my credit score by 60 points. I looked at my BK paperwork, and my attorney apparently advertently forgot to list them as a creditor. Can I force them to remove the Charge-Offs listed in 2006? Shouldn’t they just show up in 2004 when the Charge-Off occurred? I not missed a single payment to any creditor since the BK and have 2 Capital One Credit Cards in good standing. Thank you.

In any event, most likely you are protected anyway, even if the debt was not listed. The rule in most courts is that unlisted debts are discharged even if they were not listed, provided that it is the type of debt that is dischargeable. You should notify the credit bureau that you dispute the charge off listing because the debt was discharged in bankruptcy, and see what happens.
