Can I still use chapter 13 for filling?

Letter to “Ask Leon”

I have a debt over $30,000.00. And I am just six and tired of it paying for everything… I just got divorce and this is what I get. I am just wondering if I can stills use chapter 13 for filling bankruptcy instead of 17? I believe 13 is the one that you don’t need to pay it back but need to wait for 7 years to be a good credit again… Is that right?

Leon Says…

It sounds to me like you are probably more interested in Chapter 7. Chapter 7 is the kind of bankruptcy that may eliminate most kinds of debts. It stays on a person’s credit record for 10 years. However, just because you might want a chapter 7 case does not mean that you are a good candidate for Chapter 7. You can read a more detailed explanation of how consumer bankruptcy cases work by reading my Guide. In addition to that you should have an in-person meeting with a bankruptcy attorney to discuss your options.
